The Ross County Grand Jury returned all 26 of its presented cases on Friday as true bills, only 7 were open indictments.

Brian A. Hurley, 37, of Chillicothe, has been charged with a single fourth-degree felony count of carrying concealed weapons, and two fifth-degree felony counts of unlawful possession of a dangerous ordinance and aggravated possession of drugs.

According to the Ross County Prosecutor’s Office, the original incident took place on March 19th when Ross County Sheriff deputies were called to a Moss Hollow Road address in reference to a person sleeping in a vehicle on the roadway.

Investigating deputies identified the occupant of the vehicle as Mr. Hurley, and found he was wanted on several outstanding warrants. He was subsequently taken into custody.

A search of the vehicle revealed a functioning 12-gauge sawed-off shotgun between the seat and center console and a black case containing needles, drug paraphernalia and a crystalline substance that would later test positive as 1.46 grams of methamphetamine.

Mr. Hurley faces up to 18 months incarceration and a fine of $5000 if found guilty on the charge of concealed weapons. He faces up to 12 months and a $2,500 fine for each of the fifth-degree dangerous ordinance and drug possession charges.

Mr. Hurley was also indicted on a separate charge of fourth-degree felony receiving stolen property from another case on another date.

The original charge against Mr. Hurley is this case involves a reported stolen vehicle in which Mr. Hurley was found to be in illegal possession of.

This incident took place in February when Chillicothe Police were dispatched to Walgreens on North Bridge Street after it was reported that a stolen vehicle may be on the property.

Investigating officers located the vehicle and confirmed it was the same vehicle reported stolen a week earlier from an address on Water Street.

Mr. Hurley was identified as the driver of the vehicle. He was then placed under arrest for receiving stolen property. If found guilty of this charge, Mr. Hurley faces up to 18 months jail time, and a $5000 fine.

Nicholi T. Butterbaugh, 22, of Chillicothe, faces two separate felony indictments, both for possession of heroin, from separate cases that took place in early and mid April.

The first charge against Mr. Butterbaugh comes from an offense that took place on April 11th when Chillicothe Police Detectives received information that Mr. Butterbaugh was set to pick up some drugs. Detectives set up surveillance of Mr. Butterbaugh and caught up with him once the alleged deal was complete. Mr. Butterbaugh was found to be in possession of 16.07 grams of heroin, which he voluntarily revealed to detectives.

Mr. Butterbaugh was also indicted on single second-degree felony charge of possession of heroin following an incident nine days prior on April 2nd where a State Patrol Trooper conducted a traffic stop on a vehicle traveling along U.S. 35. A probable cause search of Mr. Butterbaugh’s person revealed a bag containing 10.09 grams of suspected heroin.

Mr. Butterbaugh faces up to 8 years and a fine of $15,000 on each charge.

Shane A. Darling, 31, of Chillicothe, has been indicted on a single second-degree felony charge of possession of heroin. Mr. Darling is a co-defendant in the case from April 2nd involving the aforementioned Mr. Nicholi Butterbaugh.

Mr. Darling was riding a passenger in the vehicle along with Mr. Butterbaugh when their vehicle was stopped along U.S. 35. A probable cause search of Mr. Darling’s person revealed two bags of suspected heroin, one weighing 10.02 grams, the other weighing 11.94 grams.

If convicted, Mr. Darling could receive up to 8 years incarceration and a fine of $15,000.

Antoine D. Windom, 53, of Chillicothe, has been indicted on two counts of second-degree felony robbery. He faces up to 8 years and a fine of $15,000 dollars. The charges against Mr. Windom comes from and incident on March 30th when Mr. Windom was positively identified by the victim of an assault and robbery as their attacker.

Helena C. Honaker, 18, of Chillicothe, has been indicted on a single first-degree misdemeanor charge of theft, and a fifth-degree felony count of escape. The charges against Ms. Honaker are from March 27th when Chillicothe Police were called to the Chillicothe Wal-Mart on a report of a shoplifting. Officers soon made contact with Ms. Honaker, who admitted to stealing items from the store. While in custody, Ms. Honaker complained that she felt ill and was subsequently taken to Adena Regional Medical Center. An officer was waiting to take Ms. Honaker into custody once she was released from the hospital, however, she fled the hospital premises before the officer could do so.
